When a user (hereinafter a “User”) accesses and/or uses the https://www.seekube.com/ and https://app.seekube.com/ websites or any other website published by HELLOWORK and using the domain name seekube.com, or one of its sub-domains (hereinafter referred to collectively as the “Website”), HELLOWORK (hereinafter “HELLOWORK”) the publisher of the Website, agrees to process the personal data collected on Users in accordance with the applicable personal data processing regulations (in particular, Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 (hereinafter referred to as the “GDPR”) and French Data Protection Law No. 78-17 of 6 January 1978, as amended).

This privacy policy (hereinafter the “Privacy Policy”) sets out the terms and conditions for processing Users’ personal data when they access and/or use the Website.

Users agree to familiarise themselves with these terms and conditions before browsing the Website.

 

Article 1. Definitions

  • Candidate”: refers to any natural person using the Website and seeking employment or training.
  • User Account”: refers to an account created by a User which is either a:
    • Candidate Account”: refers to an account created by a Candidate User;
    • Exhibitor Account”: refers to an account created by an Exhibitor User;
    • Organiser Account”: refers to an account created by an Organiser User.
  • Exhibitor”: refers to any person wishing to contact a Candidate.
  • Organiser”: refers to any person wishing to organise an event to bring Exhibitors and Candidates together.
  • User”: refers to any natural person accessing and browsing the Website.

Automated systems or software accessing the Website are expressly considered to be non-legitimate users of the Website and Services.

Other capitalised terms used in the Privacy Policy, and not expressly defined, refer to the definitions contained in Article 4 of the GDPR.

 

Article 2. Who is responsible for processing Users' Personal Data?

HELLOWORK, a French SASU [simplified single shareholder limited company] with share capital of €168,672, with its registered office at 2 rue de la Mabilais in (35000) Rennes, listed in the Rennes Register of Trade and Companies as number 428 843 130, determines the purposes and means of processing Users’ Personal Data.

On this basis, HELLOWORK acts as the Data Controller.

Users can contact the HELLOWORK Data Protection Officer (DPO), Mr Philippe LESAUVAGE, for any Personal Data-related questions.

This makes it possible to produce anonymised statistics on the job market, training, career advancement and working life. HELLOWORK may also use the responses to improve Website functioning.

In HELLOWORK’s legitimate interest

Users' Personal Data may be further processed for statistical purposes.

Candidate Users who are minors: Candidate Users aged between 15 and 18 can give their own consent to their Personal Data being processed.

 

Article 5. What Personal Data are collected? 

Users’ Personal Data are processed by HELLOWORK lawfully, fairly and transparently.

HELLOWORK also agrees to ensure that the Data processed are adequate, relevant and not excessive with regard to the purposes described above (point 3 of the Privacy Policy).

HELLOWORK collects the following personal data/categories of personal data on Users for the following purposes:

  • Candidate Users: in particular, the following data:
    • Contact details (surname/first name/email/telephone number)
    • Work experience and employment status (experience, qualifications, skills, mobility, etc.)
    • Any data contained in their CV (photo, date of birth, etc.)
  • Exhibitor or Organiser Users: Contact details (surname/first name/company/position/email/telephone).
  • All Users:
    • Identification data,
    • Login data,
    • Usage data.

HELLOWORK never asks for “sensitive” information (race, ethnicity, religious opinions, etc.). HELLOWORK advises Users not to provide such information when using its Website and Services.

If, however, Users choose to provide such information, they do so at their own initiative and under their own responsibility.

All data required to process Users' requests will be shown. Some data is mandatory in order to process Users' requests. If such mandatory data are not provided, HELLOWORK will not be able to process the request from the User in question.

Article 6. Who are the recipients of Users’ Personal Data?

Generally speaking, personal data collected as part of the services are accessible to authorised departments of HELLOWORK or of any entity to which HELLOWORK belongs within the meaning of Article L 233-3 of the French Commercial Code: customer relationship management team, technical implementation team.

HELLOWORK may also give access to such data to:

  • technical service providers: hosting, email delivery service, IT audit and security service provider;
  • authorised third parties to which HELLOWORK may be obliged to communicate such data by virtue of a legal obligation to which HELLOWORK may be subject.

Users' contact details, in particular, are held centrally in a directory linked to the platform.

Some of the data contained in this directory can be consulted by other Users depending on their status.

As such:

  • Some Candidate User data is accessible to Exhibitor Users and Organiser Users when Candidate Users approach them, for example, by submitting an application for a job offer, internship or training course or uploading their CV to the CV Library [Cvthèque], etc.)
  • Some Exhibitor Users' data are accessible to other Exhibitor Users and to Organiser Users.
  • Some Organiser Users' data are accessible to Exhibitor Users.

HELLOWORK draws Users’ attention to the following when they register on the Website using the “Register with […]” button. If you sign in from an existing Linkedin, Google or Facebook account or from any other service, your information (surname, first name and email address) from these accounts will be stored in HELLOWORK's files for the purposes of managing your registration and enabling you to use HELLOWORK's services.

As these applications are third party applications or websites that are not managed by HELLOWORK, their use may result in data processing being carried out by their publishers, over which HELLOWORK has no control and cannot be considered as data controller. You are invited to familiarise yourself with these third-party applications before using these buttons. Users may disconnect their User Account from their third-party application account by consulting the privacy policy of the third-party application in question.

 

Article 7. How long is Users’ personal data kept for?

HELLOWORK only keeps Users' personal data, in an identifiable form, for the time strictly needed to achieve the purposes shown above (point 3 of the Privacy Policy).

The retention period for Users' Personal Data is, therefore, for:

Candidate Users

Candidate Users’ personal data may be kept for a maximum of thirty (30) months from the last contact with the Candidate User.

Exhibitor or Organiser Users

Exhibitor or Organiser Users’ personal data will be kept for a maximum of thirty (30) months from the last contact.

Other User

The Personal Data of any other User concerned may be kept for a maximum of three (3) years from their collection or from the last contact.

HELLOWORK may archive some of the Users' Personal Data in order to establish, exercise or defend its legal rights or to comply with a legal obligation.

 

Article 8. What rights do Users have over their Personal Data?

Users have a number of rights over their Personal Data. They may exercise these rights by contacting the DPO, Mr Philippe LESAUVAGE.

Should HELLOWORK have reasonable doubt as to the identity of Users sending Personal Data-related requests, Users may be asked to prove their identity.

Access

At Users’ request, HELLOWORK will inform said Users whether or not it is processing their Personal Data.

If such data is being processed, HELLOWORK will provide Users with:

  • information on purposes, data/categories of data in question, recipients, retention periods and rights,
  • a copy of this information.

For any further copies, HELLOWORK may charge a reasonable fee based on the administrative costs incurred by such a request.

If this access request is made electronically, the information will be sent to the User electronically (unless the User requests otherwise).

 

Rectification

At Users’ request, HELLOWORK may modify said Users’ Personal Data, as soon as possible, if they are inaccurate or incomplete.

HELLOWORK will notify the User in question of the rectification or deletion of Personal Data, or the restriction of processing of the User’s Personal Data, unless such communication proves impossible or requires disproportionate effort.

Deletion

At Users’ request, HELLOWORK may delete said Users’ Personal Data, as soon as possible, if one of the reasons listed in Article 17 of the GDPR applies.

In particular, if the data processed are no longer required by HELLOWORK for the purpose(s) for which they were collected.

Restriction

At the User's request, HELLOWORK may restrict the processing of said User’s Personal Data for one of the reasons listed in Article 18 of the GDPR.

In particular, if the accuracy of the processed data is disputed (temporary restriction by HELLOWORK) or if HELLOWORK no longer requires the data.

Objection

Users may object at any time to the processing of their Personal Data under the terms and conditions set out in Article 21 of the GDPR (in particular, if the data is processed for canvassing purposes, or in view of the User's particular situation).

 

Portability

At Users’ request, HELLOWORK may send said Users their Personal Data in a structured, commonly used and machine-readable format.

This right only relates to Personal Data provided by the User.

HELLOWORK may transfer the data concerned directly to another data controller (if this is technically possible).

Death

Individual Users are entitled to give instructions relating to the retention, deletion and communication of their Personal Data after their death.

The Users in question may modify or revoke their instructions at any time.

Complaint

If Users consider that the processing of their Personal Data constitutes a breach of the applicable regulations, they may file a complaint with the CNIL:

Article 9. Automated decision-making

HELLOWORK does not take any User-related decisions based exclusively on Automated Processing, including profiling, that produce legal or similarly significant effects for the User.

 

Article 10. What measures are taken to ensure the security of Users' Personal Data?

Users’ Personal Data collected by HELLOWORK are processed in such a way as to guarantee appropriate security. The data are also processed in such a way as to ensure that they are protected against accidental loss, destruction or damage using appropriate technical or organisational measures.

For the sake of clarity, HELLOWORK specifies how the Website uses cookies.

Cookies are commonly used on the Internet. A cookie is a small text file containing information, which is stored on the User's equipment (e.g. computer, tablet or mobile phone) and which enables the User to benefit from an enhanced user experience.

HELLOWORK uses two types of cookies: persistent cookies and session cookies.

Persistent cookies enable HELLOWORK to identify Users as existing users so that they can return to, or consult, HELLOWORK services without having to re-enter their login details. Once logged in, a persistent cookie remains in the User's browser and will be read by HELLOWORK when the User returns to the Website.
